(1) For and in consideration of the transportation services to be provided, shipper agrees to pay all applicable freight and delivery charges to DATA EXPEDITERS, as set forth in it's written rate circulars and as agreed upon. 

(2) Shipper warrants that the shipment(s) identified is properly packaged to withstand the rigors of transportation, will not contaminate other freight with which it may be co-loaded and contains no toxic or controlled substances or hazardous materials sudject to U.S.D.O.T regulation.  Shipper agrees to defend, indemnify and hold DATA EXPEDITERS harmless from any claims resulting from the breach of such warranty.

(3) ALL SHIPMENTS MAY, AT ANY TIME DURING THE TRANSPORTATION, BE OPENED AND INSPECTED BY DATA EXPEDITERS , ANY CARRIER, AGENT, OR SECURITY AGENCY.

(4) Shipments tendered have an agreed value of not greater than $100.00(one hundred)USD. DATA EXPEDITERS cannot be held liable for occurences beyond it's control, which resulted in the loss or late delivery of shipment.
